146 禁止されるコンピュータへの無権限アクセス

(a) 定義

(1) 本条においては,次の各用語は,次のとおりに示された意味を有する。

(2) 「アクセス」とは,コンピュータ・プログラム,コンピュータ・システムもしくはコンピュータ・ネットワークに命令すること,これらと通信すること,これらの中にデータを記憶すること,これらの中からデータを検索すること,もしくは,傍受すること,または,その他これらの資源を使用できるようにすることを意味する。

(3)

(i) 「総額」とは,被害者が被った財産もしくはサービスの直接的な損失を意味する。

(ii) 「総額」は,犯罪行為によって喪失し,盗取され,または,回復不能にされた金銭,財産もしくはサービスの価値,または,コンピュータ・プログラム,コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワークがアクセスによって改変され,獲得され,毀損され,削除され,混乱させられ,または,破壊されたかどうかを確認するために被害者によって現実に支出された合理的な必要経費を含む。

(4)

(i) 「コンピュータ」とは,論理機能,演算機能もしくは記憶機能を実行する電子的,磁気的,光学的,有機的,または,その他のデータ処理装置もしくはデータ処理システムを意味する。

(ii) 「コンピュータ」は,当該装置もしくはシステムと直接に関連し,または,これらと一緒に運用される財産,データ記憶設備もしくは通信設備を含む。

(iii) 「コンピュータ」は,自動タイプライタ,自動タイプセッタまたは携帯用電卓を含まない。

(5) 「コンピュータ制御言語」とは,コンピュータに対し,特定の機能の実行を指示する,秩序付けられた文を意味する。

(6) 「コンピュータ・データベース」とは,情報,知識,事実,概念もしくは命令の表現であって,かつ,次のものを意味する。

(i) 一定の形式で準備されている,もしくは,準備されたものであり,または,コンピュータもしくはコンピュータ・ネットワークによって作成されたものであり,かつ,

(ii) コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワーク内で使用されるべきもの

(7) 「コンピュータ・ネットワーク」とは,次のものを介してなされる1以上のコンピュータの相互接続を意味する。

(i) 衛星通信,マイクロ波,電話線その他の通信媒体の使用,並びに,

(ii) 端末装置,または,その相互接続が持続的に維持されるか否かを問わず,2以上の相互接続されたコンピュータで構成される複合体

(8) 「コンピュータ・プログラム」とは,関連データと相互運用できる命令または文の秩序付けられたセットであって,かつ,コンピュータ・システム内で実行されると,コンピュータに対し,指定された機能を実行させるものを意味する。

(9) 「コンピュータ・サービス」は,コンピュータ時間,データ処理及び記憶機能を含む(これらに限定されるわけではない。)。

(10) 「コンピュータ・ソフトウェア」とは,コンピュータ・システムの運用に関連するコンピュータ・プログラム,命令,手順または関連文書を意味する。

(11) 「コンピュータ・システム」とは,1以上の,接続された,もしくは,接続されていないコンピュータ,周辺装置,ソフトウェア,データまたはプログラムを意味する。

(b) 他の適用可能な法典上の条項

本条は,本法典の他の条項の適用可能性を排除するものと解釈してはならない。

(c) 違法アクセス

(1) 何人も,意図的に,意欲して,かつ,無権限で,コンピュータ,コンピュータ・ネットワーク,コンピュータ・ソフトウェア,コンピュータ制御原語,コンピュータ・システム,コンピュータ・サービス,コンピュータ・データベース,もしくは,これらのシステムもしくはサービスの一部にアクセスし,アクセスを試み,もしくは,アクセスを発生させ,または,当該の者の権限を超過して,アクセスしてはならない。

(2) 何人も,次のいずれかの目的で,意図的に,意欲して,かつ,無権限で,コンピュータ,コンピュータ・ネットワーク,コンピュータ・ソフトウェア,コンピュータ制御原語,コンピュータ・システム,コンピュータ・サービス,コンピュータ・データベース,もしくは,これらのシステムもしくはサービスの一部にアクセスし,アクセスを試み,もしくは,アクセスを発生させ,または,当該の者の権限を超過して,アクセスしてはならない。

(i) コンピュータ,コンピュータ・ネットワーク,コンピュータ・ソフトウェア,コンピュータ制御原語,コンピュータ・システム,コンピュータ・サービス,コンピュータ・データベース,もしくは,これらのシステムもしくはサービスの一部に機能不全を発生させるため,もしくは,その運用を阻害するため,または,

(ii) コンピュータ,コンピュータ・ネットワーク,コンピュータ・システム,コンピュータ・サービス,コンピュータ・データベース,もしくは,これらのシステムもしくはサービスの一部によって記憶され,維持され,もしくは,作成されるデータもしくはコンピュータ・プログラムを,改変するため,毀損するため,もしくは,破壊するため

(3) 何人も,意図的に,かつ,無権限で,

(i) 有効なアクセス・コードを所持し,同定し,もしくは,その同定を試みてはならない。または,

(ii) 権限を有しない他人に対して,有効なアクセス・コードを配布し,もしくは,公開してはならない。

(d) 処罰

(1) 本条第(c)(1)の条項に違反した者は,軽罪として有罪であり,有罪判決に基づき,1,000ドル以下の罰金刑もしくは3年以下の拘禁刑に処し,または,これらを併科する。

(2)

(i) 本条第(c)(2)もしくは第(c)(3)の条項に違反した者は,総額が10,000ドル未満である場合には,軽罪として有罪であり,有罪判決に基づき,5,000ドル以下の罰金刑もしくは5年以下の拘禁刑に処し,または,これらを併科する。

(ii) 本条第(c)(2)もしくは第(c)(3)の条項に違反した者は,総額が10,000ドル以上である場合には,軽罪として有罪であり,有罪判決に基づき,10,000ドル以下の罰金刑もしくは10年以下の拘禁刑に処し,または,これらを併科する。

(e) 犯罪行為の範囲,裁判管轄権

(1) コンピュータ,コンピュータ・ネットワーク,コンピュータ制御言語,コンピュータ・システム,コンピュータ・サービス,コンピュータ・ソフトウェア,コンピュータ・データベース,または,これらのシステムもしくはサービスの一部に対してなされた複数の違法アクセス行為が,本条の規定に違反して1個の計画に従って実行された場合,または,継続的行為の一部であった場合には,当該行為を1個の犯罪行為とみなすことができる。

(2) この州内において競合する裁判管轄権を有する裁判所は,次のいずれかの郡において,本条第(c)項の条項の違反で起訴された者に対して,公判を実施することができる。

(i) 当該の者が行為を実行した郡,または,

(ii) アクセスされたコンピュータが所在する郡

Article 27 Crimes and Punishments

 

§146. Unauthorized access to computers prohibited.

(a) Definitions.-

(1) In this section the following words have the meanings indicated.

(2) "Access" means to instruct, communicate with, store data in, retrieve, intercept data from, or otherwise use the resources of a computer program, computer system, or computer network.

(3)

(i) "Aggregate amount" means any direct loss of property or services incurred by a victim.

(ii) "Aggregate amount" includes the value of any money, property, or service lost, stolen, or rendered unrecoverable by the offense, or any actual reasonable expenditure incurred by the victim to verify whether a computer program, computer, computer system, or computer network was altered, acquired, damaged, deleted, disrupted, or destroyed by the access.

(4)

(i) "Computer" means an electronic, magnetic, optical, organic, or other data processing device or system that performs logical, arithmetic, memory, or storage functions.

(ii) "Computer" includes any property, data storage facility, or communications facility that is directly related to or operated in conjunction with that device or system.

(iii) "Computer" does not include an automated typewriter, or typesetter, or a portable calculator.

(5) "Computer control language" means any ordered statements that direct a computer to perform specific functions.

(6) "Computer data base" means a representation of information, knowledge, facts, concepts, or instructions that:

(i) Are being prepared or have been prepared in a formalized manner or are or have been produced by a computer, computer system, or computer network; and

(ii) Are intended for use in a computer, computer system, or computer network.

(7) "Computer network" means the interconnection of 1 or more computers through:

(i) The use of a satellite, microwave, line, or other communication media; and

(ii) Terminals or a complex consisting of 2 or more interconnected computers whether or not the interconnection is continuously maintained.

(8) "Computer program" means an ordered set of instructions or statements that may interact with related data that, when executed in a computer system, causes the computer to perform specified functions.

(9) "Computer services" includes, but is not limited to, computer time, data processing, and storage functions.

(10) "Computer software" means computer programs, instructions, procedures, or associated documentation that is concerned with the operation of a computer system.

(11) "Computer system" means 1 or more connected or unconnected computers, peripheral devices, software, data, or programs.

(b) Other applicable Code provisions.-

This section does not preclude the applicability of any other provision of this Code.

(c) Illegal access.-

(1) A person may not intentionally, willfully, and without authorization access, attempt to access, cause access, or exceed the person's authorized access, to a computer, computer network, computer software, computer control language, computer system, computer services, computer data base, or any part of these systems or services.

(2) A person may not intentionally, willfully, and without authorization access, attempt to access, cause access, or exceed the person's authorized access, to a computer, computer network, computer software, computer control language, computer system, computer services, computer data base, or any part of these systems or services to:

(i) Cause the malfunction or interrupt the operation of a computer, computer network, computer software, computer control language, computer system, computer services, computer data base, or any part of these systems or services; or

(ii) Alter, damage, or destroy data or a computer program stored, maintained, or produced by a computer, computer network, computer system, computer services, computer data base, or any part of these systems or services.

(3) A person may not intentionally, willfully, and without authorization:

(i) Possess, identify, or attempt to identify any valid access codes; or

(ii) Distribute or publicize any valid access codes to any unauthorized person.

(d) Penalty.-

(1) Any person who violates any provision of subsection (c) (1) of this section is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $1,000 or imprisonment not exceeding 3 years or both.

(2)

(i) Any person who violates any provision of subsection (c) (2) or (c) (3) of this section where the aggregate amount of the loss is less than $10,000 is guilty of a misdemeanor and on conviction is subject to a fine not exceeding $5,000 or imprisonment not exceeding 5 years or both.

(ii) Any person who violates any provision of subsection (c) (2) or (c) (3) of this section where the aggregate amount of the loss is $10,000 or greater is guilty of a felony and on conviction is subject to a fine not exceeding $10,000 or imprisonment not exceeding 10 years or both.

(e) Scope of offenses; jurisdiction.-

(1) When illegal access to a computer, computer network, computer control language, computer system, computer services, computer software, computer data base, or any part of these systems or services is committed in violation of this section pursuant to 1 scheme or continuing course of conduct, the conduct may be considered as 1 offense.

(2) A court of competent jurisdiction in this State may try a person who allegedly violates any provision of subsection (c) of this section in any county in this State where:

(i) The person performs the act; or

(ii) The accessed computer is located.
