97款第45章第1 定義

 本章においては,次の各用語は,文脈が明らかに他の意味を要求しない限り,以下に規定する意味を有する。

(a) 「アクセス」とは,コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワーク上でプログラムを作成すること,プログラムを実行すること,これらと通信すること,これらの中にデータを記憶すること,これらの中からデータを検索すること,または,その他,データもしくはプログラムを含め,これらの資源を利用できるようにすることを意味する。

(b) 「コンピュータ」は,論理機能,演算機能及び記憶機能を実行する電子装置,磁気装置,光学装置またはその他の高速データ処理装置もしくはシステムを意味し,かつ,当該装置もしくはシステムと直接に関連し,もしくは,これらと共に運用される財産,データ記憶装置または通信設備を含む。「コンピュータ」は,自動タイプライタもしくは自動タイプセッタ,データベース機能を内蔵せずに文書作成機能のためにのみ設計された装置並びに携帯用電卓を含まない。また,「コンピュータ」は,コンピュータ内のコンポーネントと類似のコンポーネントを内蔵する装置であっても,当該制御される装置がデータ・プロセッサである場合またはそれが知的記憶装置であり,それらが内蔵されている場合を除き,そのコンポーネントが,当該装置の予定する単一の目的のためにその装置を制御する機能しか持たない場合には,含まれない。

(c) 「コンピュータ・ネットワーク」とは,関連し,リモートで接続された装置及び当該通信設備を通じてデータ転送をすることができる少なくとも1以上のコンピュータ・システムを含む通信設備のセットを意味する。

(d) 「コンピュータ・プログラム」とは,コード化された命令または文を表現するデータの秩序付けられたセットであって,かつ,それがコンピュータで実行されると,コンピュータにデータ処理をさせるものを意味する。

(e) 「コンピュータ・ソフトウェア」とは,コンピュータ・システムの運用に関係するコンピュータ・プログラム,手順及び関連文書のセットを意味する。

(f) 「コンピュータ・システム」とは,機能的に関連し,接続され,もしくは,接続されていないコンピュータ装置,機器またはソフトウェアのセットを意味する。

(g) 「コンピュータ・サービス」とは,コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワークへのアクセスを提供すること,または,これらからサービスもしくはデータを提供することを意味し,そして,実際のデータ処理を含む。

(h) 「証券」とは,小切手,支払指図書,為替,定期預金証書,信用状,為替手形,1972年ミシシッピ州法典第97款第19章第9条第(b)項に規定するクレジットカードまたは市場性有価証券を意味する。

(i) 「知的財産」は,コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワークの中に記憶され,これらによって作成され,これらで使用されるべき,または,これらに記憶されるべき場合には,どのような形式・媒体であるかを問わず,データ,コンピュータ・プログラム,コンピュータ・ソフトウェア,トレード・シークレット,著作権のあるマテリアル,機密情報もしくは専有情報を含む。

(j) 「財産」とは,1972年ミシシッピ州法典第1款第3章第45条に規定する財産を意味し,とりわけ,機械に読み取り可能であるか人間に読み取り可能であるかを問わず,証券,電子的に記憶され作成されたデータ及びコンピュータ・プログラムを含む(これらに限定されるわけではない。)。

(k) 「本来の方法」は,次のいずれかを含む。

(i) 独立した発明による発見

(ii) 「リバース・エンジニアリング」;それは,知られたプロダクトからスタートし,それを開発した方法を見出すために後戻りすることである。知られたプロダクトの取得は,適法な手段によるのでなければならない。

(iii) 保有者からの許可もしくは権限に基づく発見

(iv) 公に使用され,もしくは,公に展示された財産の観察,または

(v) 出版物の中からの発見

(l) 「使用」とは,使用できるようにすること,誰かのサービスへ転換すること,自分で利用できるようにすること,または,働かせることを意味する。本法の文脈においては,「使用」は,コンピュータに命令すること,これと通信すること,これにデータを記憶すること,これからデータを検索すること,または,コンピュータの論理機能,演算機能もしくは記憶機能のその他の利用を含む。

97款第45章第3 コンピュータ詐欺

(1) コンピュータ詐欺は,次のいずれかの目的で,コンピュータ,コンピュータ・システム,もしくは,コンピュータ・ネットワークにアクセスすること,または,アクセスされるようにすることである。

(a) 詐欺,または,

(b) 虚偽もしくは詐欺的な行為,業務,表現という方法による,または,プログラムもしくはデータの虚偽または詐欺的な改変,削除もしくは挿入を介してなされる,金銭,財産もしくはサービスの入手

(2) コンピュータ詐欺の罪を実行した者は,有罪判決に基づき,10,000.00ドル以下の罰金刑もしくは5年以下の拘禁刑に処し,または,これらを併科する。

97款第45章第5 コンピュータ・ユーザに対する侵害

(1) コンピュータ・ユーザに対する侵害罪は,意図してなされる次のいずれかの行為である。

(a) 同意なく,権限を有するユーザに対して,コンピュータ,コンピュータ・システム,コンピュータ・ネットワークもしくはコンピュータ・サービスの完全かつ有効な使用またはアクセスを拒否すること,または,

(b) 同意なく,コンピュータ,コンピュータ・システム,コンピュータ・ネットワークもしくはコンピュータ・サービスにアクセスするための番号,コード,パスワードその他の手段を他人へ開示すること

(2) コンピュータ・ユーザに対する侵害罪を実行した者は,その有罪判決に基づき,1,000.00ドル以下の罰金刑もしくは6月以下の拘禁刑に処し,または,これらを併科する。但し,損害または損失が100.00ドル以上である場合には,その有罪判決に基づき,10,000.00ドル以下の罰金もしくは5年以下の拘禁刑に処し,または,これらを併科する。

97款第45章第7 コンピュータ装置に対する侵害

(1) コンピュータ装置またはサプライに対する侵害罪は,コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワークで使用される,もしくは,使用されるべきコンピュータ装置またはサプライの,意図して,同意なくなされる改変または破壊である。

(2) コンピュータ装置またはサプライに対する侵害罪を実行した者は,その有罪判決に基づき,1,000.00ドル以下の罰金もしくは6月以下の拘禁刑に処し,または,これらを併科する。但し,損害または損失が100.00ドル以上である場合には,その有罪判決に基づき,10,000.00ドル以下の罰金もしくは5年以下の拘禁刑に処し,または,これらを併科する。

97款第45章第9 知的財産に対する侵害

(1) 知的財産に対する侵害罪は,意図してなされる次のいずれかの行為である。

(a) 同意なく,知的財産を破壊すること,挿入すること,もしくは,改変すること,または,

(b) 同意なく,知的財産を開示すること,使用すること,複製すること,入手すること,もしくは,それにアクセスすること

(2) 知的財産に対する侵害罪を実行した者は,その有罪判決に基づき,1,000.00ドル以下の罰金もしくは6月以下の拘禁刑に処し,または,これらを併科する。但し,損害または損失が100.00ドル以上である場合には,その有罪判決に基づき,10,000.00ドル以下の罰金もしくは5年以下の拘禁刑に処し,または,これらを併科する。

(3) 本条の規定は,本章に規定する本来の意味による開示行為,使用行為,複製行為,入手行為,または,アクセス行為については,適用されない。

97款第45章第11 裁判管轄地

本章の規定に基づく裁判管轄に関しては,本章の違反行為は,次のいずれかの場所で実行されたものとみなす。

(a) 本章に違反する行為の遂行中に実行された行為が起きた郡

(b) 電話,電磁波,マイクロ波,その他の通信手段が何であるかを問わず,コンピュータ,コンピュータ・システムもしくはコンピュータ・ネットワークへのアクセスの発信地,目的地または通過地であった郡

97款第45章第13 他の犯罪に対する影響

本章により犯罪行為が成立する場合であっても,そのことによって,他の犯罪行為が取り消され,または,無効になるものと解釈してはならない。

Chapter 45. Computer Crimes

 

Sec. 97-45-1. Definitions.

For the purposes of this chapter, the following words shall have the meanings ascribed herein unless the context clearly requires otherwise:

(a) "Access" means to program, to execute programs on, to communicate with, store data in, retrieve data from or otherwise make use of any resources, including data or programs, of a computer, computer system or computer network.

(b) "Computer" includes an electronic, magnetic, optical or other high-speed data processing device or system performing logical arithmetic and storage functions and includes any
property, data storage facility or communications facility directly related to or operating in conjunction with such device or system. "Computer" shall not include an automated typewriter or typesetter, a machine designed solely for word processing which contains no data base intelligence or a portable hand-held calculator nor shall "computer" include any other device which contains components similar to those in computers but in which the components have the sole function of controlling the device for the single purpose for which the device is intended unless the thus controlled device is a processor of data or is a storage of intelligence in which case it too is included.

(c) "Computer network" means a set of related, remotely connected devices and communication facilities including at least one (1) computer system with the capability to transmit data through communication facilities.

(d) "Computer program" means an ordered set of data representing coded instructions or statements that when executed by a computer cause the computer to process data.

(e) "Computer software" means a set of computer programs, procedures and associated documentation concerned with operation of a computer system.

(f) "Computer system" means a set of functionally related, connected or unconnected, computer equipment, devices or computer software.

(g) "Computer services" means providing access to or service or data from a computer, a computer system or a computer network and includes the actual data processing.

(h) "Financial instrument" means any check, draft, money order, certificate of deposit, letter of credit, bill of exchange, credit card as defined in Section 97-19-9(b), Mississippi Code of 1972, or marketable security.

(i) "Intellectual property" includes data, computer programs, computer software, trade secrets, copyrighted materials and confidential or proprietary information in any form or medium when such is stored in, produced by or intended for use or storage with or in a computer, a computer system or a computer network.

(j) "Property" means property as defined in Section 1-3-45, Mississippi Code of 1972, and shall specifically include, but not be limited to, financial instruments, electronically stored or produced data and computer programs, whether in machine readable or human readable form.

(k) "Proper means" includes:

(i) Discovery by independent invention;

(ii) Discovery by "reverse engineering"; that is, by starting with the known product and working backward to find the method by which it was developed. The acquisition of the known product must be by lawful means;

(iii) Discovery under license or authority of the owner;

(iv) Observation of the property in public use or on public display; or

(v) Discovery in published literature.

(l) "Use" means to make use of, to convert to one's service, to avail oneself of or to employ. In the context of this act, "use" includes to instruct, communicate with, store data in or
retrieve data from, or otherwise utilize the logical arithmetic or memory functions of a computer.

Sec. 97-45-3. Computer fraud; penalties.

(1) Computer fraud is the accessing or causing to be accessed of any computer, computer system, computer network, or any part thereof with the intent to:

(a) Defraud; or

(b) Obtain money, property or services by means of false or fraudulent conduct, practices or representations; or through the false or fraudulent alteration, deletion or insertion of programs or data.

(2) Whoever commits the offense of computer fraud shall be punished, upon conviction, by a fine of not more than Ten Thousand Dollars ($10,000.00), or by imprisonment for not more than five (5) years, or by both such fine and imprisonment.

Sec. 97-45-5. Offense against computer users; penalties.

(1) An offense against computer users is the intentional:

(a) Denial to an authorized user, without consent, of the full and effective use of or access to a computer, a computer system, a computer network or computer services; or

(b) Use or disclosure to another, without consent, of the numbers, codes, passwords or other means of access to a computer, a computer system, a computer network or computer services.

(2) Whoever commits an offense against computer users shall be punished, upon conviction, by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six (6) months, or by both such fine and imprisonment. However, when the damage or loss amounts to a value of One Hundred Dollars ($100.00) or more, the offender may be punished, upon conviction, by a fine of not more than Ten Thousand Dollars ($10,000.00), or imprisonment for not more than five (5) years, or by both such fine and imprisonment.

Sec. 97-45-7. Offense against computer equipment; penalties.

(1) An offense against computer equipment or supplies is the intentional modification or destruction, without consent, of computer equipment or supplies used or intended to be used in a computer, computer system or computer network.

(2) Whoever commits an offense against computer equipment or supplies shall be punished, upon conviction, by a fine of not more than One Thousand Dollars ($1,000.00), or by
imprisonment for not more than six months or both such fine and imprisonment. However, when the damage or loss amounts to a value of One Hundred Dollars ($100.00) or more, the offender may be punished, upon conviction, by a fine of not more than Ten Thousand Dollars ($10,000.00) or by imprisonment for not more than five (5) years, or by both such fine and imprisonment.

Sec. 97-45-9. Offense against intellectual property; penalties.

(1) An offense against intellectual property is the intentional:

(a) Destruction, insertion or modification, without consent, of intellectual property; or

(b) Disclosure, use, copying, taking or accessing, without consent, of intellectual property.

(2) Whoever commits an offense against intellectual property shall be punished, upon conviction, by a fine of not more than One Thousand Dollars ($1,000.00), or by imprisonment for not more than six (6) months, or by both such fine and imprisonment. However, when the damage or loss amounts to a value of One Hundred Dollars ($100.00) or more, the offender may be punished, upon conviction, by a fine of not more than Ten Thousand Dollars ($10,000.00) or by imprisonment for not more than five (5) years, or by both such fine and imprisonment.

(3) The provisions of this section shall not apply to the disclosure, use, copying, taking, or accessing by proper means as defined in this chapter.

Sec. 97-45-11. Venue.

For the purposes of venue under the provisions of this chapter, any violation of this chapter shall be considered to have been committed:

(a) In any county in which any act was performed in furtherance of any transaction violating this chapter; and

(b) In any county from which, to which or through which any access to a computer, computer system or computer network was made, whether by wire, electromagnetic waves, microwaves or any other means of communication.

Sec. 97-45-13. Effect on other offenses.

The criminal offenses created by this chapter shall not be deemed to supersede, or repeal, any other criminal offense.
