第43章B コンピュータ・プログラム
第43章B第1条 コンピュータの違法使用
次のいずれかの者は，コンピュータの違法使用により有罪である。
(1) 認識して，保有者の同意なく，コンピュータ・システムもしくはその一部の使用を入手した者，もしくは，これにアクセスした者
(2) 認識して，保有者の同意なく，コンピュータ・プログラムもしくはデータを改変した者，もしくは，破壊した者
(3) コンピュータ・システムの保有者もしくは第三者から金銭，財産もしくはサービスを入手するための詐欺行為の一部として，認識して，コンピュータ・システムもしくはその一部の使用を入手した者，これを改変した者，これにアクセスした者，もしくは，これを破壊した者，または，
(4) 認識して，保有者の同意なく，コンピュータ，コンピュータ・プログラムもしくはコンピュータ・システムにアクセスするための番号，コード，パスワードその他の手段を使用した者，他人に対して開示した者，または，使用を試みた者，もしくは，他人へ対する開示を試みた者
第43章B第2条 用語の定義
本章で用いられる用語は，文脈が他の意味を要求しない限り，
(1) 「アクセス」とは，コンピュータ，コンピュータ・システムもしくはコンピュータ・ネットワークに命令すること，これらと通信すること，これらの中にデータを記憶すること，これの中からデータを検索することを意味する。
(2) 「コンピュータ」とは，自動的にデータにアクセスし，データを処理し，かつ，操作の結果を供給する能力を有する内部的にプログラム化された汎用のデジタル装置を意味する。
(3) 「コンピュータ・プログラム」とは，コンピュータに受容可能な形式の，一連のコード化された命令または文であって，かつ，一定の結果を得るためにコンピュータにデータ処理をさせるものを意味する。
(4) 「コンピュータ・システム」とは，関連し，接続された装置のセットを意味し，かつ，システムに対して，指定された特別の目的を有するデータ処理タスクを実行できるようにするデータ入力装置，データ出力装置及びデータ記憶装置及びデータ通信リンク，コンピュータ・プログラム及びデータを含め（これらに限定されるわけではない。），コンピュータ及びその他の装置を含む。
第43章B第3条 システムの使用の入手，改変または破壊，同意なしのアクセスもしくは開示−損害額1000ドル以下
第43章B第1条第(1)項，第(2)項または第(4)項の条項の違反により有罪判決を受けた者は，その使用，改変，破壊，アクセスもしくは開示の価額が1,000ドル以下の場合には，クラス1の軽罪として有罪である。
第43章B第４条 システムの使用の入手，改変または破壊，同意なしのアクセスもしくは開示−損害額1000ドル超過
第43章B第1条第(1)項，第(2)項または第(4)項の条項の違反により有罪判決を受けた者は，その使用，改変，破壊，アクセスもしくは開示の価額が1,000ドルを超える場合には，クラス6の重罪として有罪である。
第43章B第5条 詐欺行為の一部としてのシステムの使用の入手，改変または破壊−損害額1000ドル以下
第43章B第1条第(3)項の条項の違反により有罪判決を受けた者は，入手した金銭，財産またはサービスの価額が1,000ドル以下の場合には，クラス１の軽罪として有罪である。
第43章B第6条 詐欺行為の一部としてのシステムの使用の入手，改変または破壊−損害額1000ドル超過
第43章B第1条第(3)項の条項の違反により有罪判決を受けた者は，入手した金銭，財産またはサービスの価額が1,000ドルを超過する場合には，クラス４の重罪として有罪である。
第43章B第7条 民事上の権利は影響を受けない
本章の条項は，民事訴訟に関する当事者の権利を拡張することもなく，減縮させることもない。
第43章B第8条 違反行為のための裁判管轄地
本章の条項に基づく裁判管轄地を定めるについては，本章の犯罪は， 本章に違反する業務の遂行中に何らかの行為が実行された郡，上記違反から得られたものに対する管理もしくは所持を違反行為者が有する郡，または，電話線，電磁波，マイクロ波，もしくは，その他の通信手段のいずれによってなされたかを問わず，コンピュータ，コンピュータ・システムもしくはコンピュータ・ネットワークへのアクセスが開始され，そのアクセスが向けられ，そのアクセスの際に経由した郡のいずれかにおいて使用された図書，記録，文書，財産，証券，コンピュータ・ソフトウェア，コンピュータ・プログラム，その他の物品に対する管理もしくは所持を違反行為者が有する郡のいずれかで実行されたものとみなす。

Chapter 43B Computer Programs
Sec. 43-43B-1. Unlawful uses of computer.
A person is guilty of unlawful use of a computer if he:
(1) Knowingly obtains the use of, or accesses, a computer system, or any part thereof, without the consent of the owner;
(2) Knowingly alters or destroys computer programs or data without the consent of the owner; or
(3) Knowingly obtains use of, alters, accesses or destroys a computer system, or any part thereof, as part of a deception for the purpose of obtaining money, property or services from the owner of a computer system or any third party; or
(4) Knowingly uses or discloses to another or attempts to use or disclose to another the numbers, codes, passwords or other means of access to a computer, computer program or computer system without the consent of the owner.
Sec. 43-43B-2. Definition of terms.
Terms used in this chapter, unless the context requires otherwise, mean:
(1) "Access," to instruct, communicate with, store data in, retrieve data from a computer, computer system or computer network;
(2) "Computer," an internally programmed, general purpose digital device capable of automatically accepting data, processing data and supplying the results of the operation;
(3) "Computer program," a series of coded instructions or statements in a form acceptable to a computer, which causes the computer to process data in order to achieve a certain result;
(4) "Computer system," a set of related, connected devices, including a computer and other devices, including but not limited to data input and output and storage devices, data communications links, and computer programs and data, that make the system capable of performing the special purpose data processing tasks for which it is specified.
Sec. 43-43B-3. Obtaining use, altering or destroying system, access and disclosure without consent -- Value one thousand dollars or less.
A person convicted of a violation of subdivision 43-43B-1 (1), (2), or (4) where the value of the use, alteration, destruction, access or disclosure is one thousand dollars or less is guilty of a Class 1 misdemeanor.
Sec. 43-43B-4. Obtaining use, altering or destroying system, access and disclosure without consent -- Value more than one thousand dollars.
A person convicted of a violation of subdivision 43-43B-1 (1), (2), or (4) where the value of the use, alteration, destruction, access or disclosure is more than one thousand dollars is guilty of a Class 6 felony.
Sec. 43-43B-5. Obtaining use, altering or destroying system as part of deception -- Value one thousand dollars or less.
A person convicted of a violation of subdivision 43-43B-1 (3) where the value of the money, property or services obtained is one thousand dollars or less is guilty of a Class 1 misdemeanor.
Sec. 43-43B-6. Obtaining use, altering or destroying system as part of deception -- Value more than one thousand dollars.
A person convicted of a violation of subdivision 43-43B-1 (3) where the value of the money, property or services obtained is more than one thousand dollars shall be guilty of a Class 4 felony.
Sec. 43-43B-7. Civil rights not affected.
The provisions of this chapter shall neither enlarge nor diminish the rights of parties in civil litigation.
Sec. 43-43B-8. Venue for violations.
For the purpose of venue under the provisions of this chapter, any violation of this chapter shall be considered to have been committed: in any county in which any act was performed in furtherance of any transaction violating this chapter; in any county in which any violator had control or possession of any proceeds of said violation or of any books, records, documents, property, financial instrument, computer software, computer program or other material, objects or items which were used in any county from which, to which or through which any access to a computer, computer system or computer network was made whether by wires, electromagnetic waves, microwaves or any other means of communication.
